Thai citizens are not eligible to apply for an ETA visa to visit Australia and must therefore apply for a subclass 600 visitor visa. If the applicant has an immediate family member such as a spouse, sibling, child, aunt, uncle, nephew, or niece, their application can be submitted under the sponsored family stream of the subclass 600 visitor visa, or they may apply under the tourist stream. If applying under the sponsored family stream, their application will require formal sponsorship by their Australian family member. Generally, most applicants, however, apply under the visitor stream, which does not require formal sponsorship.
On the topic of how long a visitor visa will be granted, this is one of the most common questions we are asked. When applying for a visitor visa, the applicant is asked for their proposed dates of travel and whether they seek to remain in Australia for up to 3, 6, 9, or 12 months. They are also asked if they intend to re-enter Australia during the validity of their visa. If the answer is yes, they are expected to provide those future dates.
The most important thing to remember is that any period of stay granted is entirely at the discretion of the case officer. For example, just because an applicant requests a period of stay of up to 12 months does not mean that if the visa is granted, it will allow for that period of stay. They may be granted a single-entry visitor visa valid for only 3 months or a 1-year visa that requires them to leave at the end of three months. They can then return to Australia for a further 3 months at any time before the validity of their visa ends.
Any period of stay requested should align with the applicant’s requirement to satisfy the genuine temporary entrant criteria. If an applicant does not have a prior history of Australian visa compliance, we do not recommend applying for a period of stay that exceeds 3 months. If an applicant requests a continuous stay exceeding 3 months, they will be required to undertake an Australian visa medical at their own expense before their application can be considered. Even if the medical is cleared, this does not guarantee the grant of the visa. In many cases when a visa is granted, the Department may still use its discretion and grant the visa validity for 1 year, with each period of stay not exceeding 3 months. “They may also add Condition 8503 to your visa grant.”
